Road traffic accidents can happen from many different circumstances. Some types of claims will mean a slightly different procedure will take place, which is why it is important to obtain advice from a specialist. Car and Driver Accident Claims
Accident or injury claims involving one or more cars obviously form the majority of compensation claims handled by MASS solicitors. To be successful in a claim you or your solicitor will need to prove that someone else was at fault or negligent. Very often the actions of another driver are obviously negligent, for instance, driving too fast or pulling out or overtaking when it was unsafe to do so but proving it may be another matter. Other factors can also cause accidents, e.g. badly maintained roads, unmarked hazards, unlit parked vehicles, untreated ice on major roads. In many circumstancres this can give rise to a claim against the local athority or Highways Agency if it can be shown that they should have been aware of the danger and failed in their duty to do something about it.
