Road traffic accidents can happen from many different circumstances. Some types of claims will mean a slightly different procedure will take place, which is why it is important to obtain advice from a specialist. MASS Members will be able to advise you on your specific circumstances.

THE GENERAL RULE IS THAT YOU CAN MAKE A CLAIM IF SOMEONE ELSE CAUSED THE ACCIDENT. Rules differ slightly in Scotland and Northern Ireland but our MASS solicitors there can guide you.

It doesn't usually matter if the person at fault was uninsured, unknown * (untraced hit & run) or even a member of your own family. In some circumstances it could be the fault of a local or highway authority for failing to clear, light or maintain a road in a safe condition.

You may also be able to claim if an animal caused the accident if it can be shown that the owner was somehow negligent in allowing it on the road in the first place.

You can claim as a driver, passenger, cyclist or pedestrian.

In most cases the compensation will be paid out by the insurance company of the person responsible. In uninsured and untraced driver cases* this duty is take on by the Motor Insurers Bureau, a quango funded by the government and paid for partly by a levy on insurance companies (who pass the cost on to you and me in insurance premiums).

* In some cases you may only be able to claim for your injury but not damage to your vehicle but your solicitor can advise if this applies to you.
