Have You Been Contacted Direct By An Insurance Company Following An Accident?

MASS is running a national campaign to warn people who have been involved in road accidents, of the dangers of dealing directly with the insurance company of the third party to settle their claim.

 

This practice is known as ‘Third Party Capture’ or ‘Third Party Assistance’ and is operated by many insurance companies who represent the driver who caused the accident.

 

They will contact the accident victim and offer to settle their claim without the use of solicitors and may also tell the accident victim not bother to seek independent legal advice. They will suggest that it will cost more and take longer to settle their claim if they do. Some may even send a sales representative to the victim’s home to persuade them to settle their claim early.

 

MASS is extremely concerned for the accident victim and wants to ensure that they get reasonable and fair compensation for the injuries they have sustained. We believe the practice of Third Party Capture is unjust and wrong, with the insurer acting as Judge, Jury and Paymaster. We also believe that there is a loophole in the regulations, which enables insurers to carry out this practice unregulated.

 

MASS is campaigning on two fronts. Firstly, we are lobbying the Government to tighten up the insurers rules and to request regulation of the practice of Third Party Capture and secondly, we want to inform and educate the public of the dangers of settling their claim without first seeking independent legal advice.
