Types of Claim

Road traffic accidents can happen from many different circumstances. Some types of claims will mean a slightly different procedure will take place, which is why it is important to obtain advice from a specialist. MASS Members will be able to advise you on your specific circumstances. Select the type of claim from the menu on the left for more information.
Passenger Claims
As a passenger it it extremely unlikely that you caused the accident and therefore you are likely to be able to succeed in a claim for compensation. This may mean making a claim against the insurers of the car in which you were travelling or against one or more of the other drivers involved.

Technically your claim will be against the driver of the vehicle that caused the accident even if it was the driver of the car you were in and that person is related to you. So you can bring a claim against your wife, husband, son , etc if they were at fault.

In practice the claim will usually be settled by the driver's insurance company or if a company car, the company or their insurers.

In some cases passenger claims will be bought against multiple drivers and when fault is sorted out between them, the passenger is paid by the insurer of the party at fault.
